For the purposes of the following documentation, the words “freecruiter”, "we", “us” and “our” will refer to Freecruiter FZCO. The terms "you" and “your” will apply to the person, firm, company or organisation using the website. The website (www.freecruiter.com) will from this point be referred to as the “site”
1. Changes to this agreement and to the website
We reserve the right to update or revise these Terms and Conditions at any time without prior notice, although changes will be reflected within this page. The changes effected will immediately be legally binding, from the time at which they are published on the site, unless otherwise stated. We also reserve the right to make changes to the site, at any time, without prior notice, at our discretion.
Use of the site is considered to be representative of your acceptance of the currently advertised Terms and Conditions on the site. If you believe the Terms and Conditions to be unacceptable, you must immediately cease to use the site. Any new terms used by you specifically, are not recognised by us unless we have confirmed our official acceptance of them in the form of a written confirmation, which includes the new terms.
2. Interruptions in service
We strive to ensure the standard of content on the site is of the highest level, and we seek to maintain the continuity of the site. However, we have no control over the stability of the medium, and as such, errors and interruptions in service could occur at any time. We do not accept any liability arising from any such occurrences, nor do we accept any obligation or responsibility to operate the site or to provide the service we offer on the site.
3. Links to external sites
This site may contain links to external sites of which we have no control over. While these sites will always be sites that we deem relevant or appropriate to you, we do not accept any responsibility or liability in respect of the content contained within those sites. We have no connection with the owners or site managers, be it commercial or otherwise, and thus we stress that when you choose to use a link to gain access to any external sites, it is entirely at your own risk.
4. Information on this site
Whilst every effort is made to ensure that the information on our site is accurate and complete at the time of publishing, we do not accept any liability arising from any inaccuracies, omissions or errors in any of the information on our site.
We also accept no liability in respect of information on the site that is supplied by you, any other website user or any other person.
5. Use of this site
You are only permitted to use the site for lawful purposes when you are either seeking employment or career assistance, when searching for or recruiting staff. Under no circumstances whatsoever are you to attempt to undermine the information published or submitted to the site, nor its security. Specifically, and without any limitations, you must never attempt to access, alter or delete any information you do not have authorised access to. You agree that you will never attempt to overload the system via spamming or flooding, you will not take any action or use any device, method or software to crash, inflict damage to or otherwise interfere with the operation of the site, or attempt to revise the software, coding or information contained within the site.
You take sole responsibility for any information you submit to the site. You are solely responsible for ensuring that all the information you supply is truthful, accurate, not misleading in anyway and that it is not discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trademark or other intellectual property rights of any person in any jurisdiction. You are also solely responsible for ensuring that all information, data and files are free of viruses, malware or engines that may damage or interfere with any system or data prior to submitting to the site. We reserve the right to remove any information you supply to the site at our own discretion, at any time, for any reason, and without explanation.
6. Information submitted by you
We will use information supplied by you (including sensitive personal data) only to aid the recruitment process and associated administrative functions. This involves the process and storage of information (including sensitive personal data) and making this available to potential employers (or third parties assisting them in their recruitment process). We may collect and aggregate data from the information you supply in order for us to better understand our users so as we are able to continually improve our service. We may also share aggregate information with selected third parties, although we will never disclose individual names or information from which any of users might be identified. You consent to us using the information you provide (including sensitive personal data) in any of the aforementioned ways.
Identity Verification: We may collect Personal Information, such as your date of birth or taxpayer identification number, to validate your identity or as may be required by law, such as to complete tax filings. We may request documents to verify this information, such as a copy of your government-issued identification or photo or a billing statement.
7. Content rights
Material rights concerning content provided on the site are protected by international copyright, software and trademark laws. You agree to use the site in such a way that does not infringe these rights. You may copy material on the site for your own private or domestic purposes, but you are not permitted to copy our content for any commercial or business use whatsoever.
8. Security and passwords
In order to register and sign in on the site, you will need to create a user name and a password. You are responsible for the security of your password. It must be kept confidential at all times and not given to any other person. If you believe your password has been compromised, you must notify us immediately. We do not accept any liability for unauthorised or improper use of any password.
We reserve the right to terminate your registration, account, or to deny you access to the site at any time. This is decision is at our own discretion, and may be made without any explanation, notification or clarification.
We do not accept any liability for any direct or indirect losses arising from your use of the site, including loss of business, revenue, profits, data, or any other consequential loss. By using the site, you agree not to seek representation as a result of your own use or misuse of the site. You also agree to indemnify us and maintain our indemnification against all potential costs, expenses, claims, losses, liabilities or proceedings arising from your use or misuse of the site. If anybody threatens to make, or makes, any claims against you resulting from your use of the site, you must notify us immediately.
11. Use of aggregate data
You agree that we take ownership, and therefore has the right to collect, compile, extract and analyse the aggregate data provided through the site. We may, at any time, use aggregate data for lawful business purposes, without any notification, provided any data or information is used in aggregate form only and is anonymised so as not to allow identification of any of our users. The term “aggregate data” refers to de-identified data or information relating to a user’s educational qualifications or career history. This can also extend to include occupation, location, salary and experience.
12. Disclaimers and limitations on Freecruiter's liability
We assume no responsibility for any information or documents posted by users, and accept no responsibility for any activities or conduct of users. We act solely as an online portal for distribution and publication of information submitted by the user; we have no obligation to monitor communications or screen information posted by users. If we are notified by a user of a post or document that does not conform to the Terms and Conditions, we may investigate the allegation and determine at our sole discretion whether we should remove or request the removal of such document. We have no liability or responsibility to users conducting such activities. We may take action with respect to user information deemed necessary or appropriate, at our sole discretion.
At no time should any content featured within the site be misinterpreted as an act of endorsement or representation of any third party or user, including others’ websites, products, solutions, services, experience, and so on…
12.2 Warranty disclaimers
a) This site is provided with no warranties implied or expressed. We will disclaim any warranties of any kind, to the fullest extent permitted by UAE law. This includes, but is not limited to, the warranties of title, non-infringement of rights, fitness for purpose and merchantability. We also provide no warranties with respect to accuracy or reliability of the site or any information contained within it.
b) We do not provide any warranty in regard to any of the operational aspects to the site. This means we are unable to warrant that the site will be free of error, free of viruses or any other harmful mechanisms. If, when using or having used the site, you require servicing or replacement of software or hardware, any equipment or data, we take no responsibility for the associated costs of the aforementioned servicing or replacements.
c) We make no guarantees or warranties relating to the content contained within the site. This extends to information inaccuracies, broken or expired links and grammatical/typographical errors.
d) We make no guarantees or warranties regarding the efficiency or timescale of the services provided via the site in terms of meeting your employment requirements. We make no guarantees whatsoever that you will find employment when using the services provided within the site, nor do we guarantee that positions advertised will be filled, or that employees placed will be retained. We accept no responsibility or liability for any decisions made by you relating to employment, hiring, salaries or general business.
12.3 Damage limitation, allocation of liability and equitable relief
All responsibility and risk is assumed by you when you choose to use the site, the internet in general, when you opt to post documents or employer materials, and how you conduct your business when using the site.
12.4 User authentication
We accept no responsibility and can provide no guarantees pertaining to user authentication. We are unable to confirm that each user is who they claim they are. We take no involvement in user-to-user relationships or connections, and we have no control over the behaviour of users on the site, unless they are discovered to be in breach of any of the aforementioned Terms and Conditions. If you have reason to begin a dispute with a user, by using the site you agree that we are not responsible for any situations that may arise as a result of this, and will be free from claims or damages (whether consequential or inconsequential, direct or indirect) of any kind or nature.
You agree that you will indemnify, defend and hold us free of accountability against any third party claims, actions or demands against you, including, but not restricted to, those concerning costs, damages and legal fees, brought as a result of your use of the site or in connection with use of the site, documents or information posted by you on the site. We will, in the case that any claim is brought against you, make every effort to inform you of this, and we may assist you in defending any such claim or proceeding, at your expense.
14. Questions and notices
Questions concerning the use of the site should be directed to the contact us page on the site. Any notices should be sent to the address given on the site. We will make every effort to respond to any such enquiries, questions or notices in a reasonable amount of time.
Our contact information is provided on the site. We make no claims as to the appropriateness of the content, and we stress that access to the content may not be legal in your jurisdiction. We accept no responsibility for this and urge you as the user to check that your online actions are in compliance with the laws relative to your own jurisdiction and the legislation upheld within. If you access the site outside of the UAE, you do so at your own risk. This agreement is governed by the national laws of the UAE, and the jurisdiction for any claims rests within the courts of the UAE. The relationship between you and Freecruiter is that of an independent contractor. If any part of this agreement is found to be invalid by a court of the UAE, the part found to be invalid will not affect the validity of the remaining provisions within this agreement, which will remain in full effect. All elements within this agreement shall survive termination, other than those that grant access to or use of the site. You must cease your use and access immediately upon termination. You are not permitted to transfer your obligations under this agreement, nor is there any waiver of this agreement. These Terms and Conditions, to which you agree by using the site, constitute the entirety of any agreement between us (Freecruiter) and you, the user.
16. Posting and conduct rules
The following rules provide an overview of the rules put in place to manage the use of the site and the services we provide. They pertain to posting documents, general conduct and behaviour when using the site.
16.1 Posting Rules
All Documents posted to Freecruiter must be posted in English, any CV or job posting submitted in other languages will be removed and the author will be requested to resubmit the document to comply with this rule.
a) You may not post any documents to the site that contain: (i) URLs or links to external websites other than your company website if you are a employer; (ii) any copyrighted material, unless you own the copyright or have permission from the individual that does; (iii) any trade secrets (unless you own them or have the owner's permission to post them); (iv) material that infringes on or misappropriates any other intellectual property rights, or violates the privacy or publicity rights of others; (v) irrelevant keywords or white text keywords (including any words embedded in the document and hidden from the user); (vi) anything that is discriminatory, sexually explicit, obscene, libellous, defamatory, threatening, harassing, abusive, or hateful; or (vii) anything that is embarrassing or offensive to another person or entity.
b) You must not use any document(s) to do any of the following: (i) impersonate another person; (ii) post false or inaccurate information; (iii) post adverts.
(c) Your document(s) must contain details which communicate clearly to the user the requirements of the job opportunity, or, in the case of users seeking employment, your qualifications as a candidate for the position for which you wish to apply.
(d) You may not advertise multiple job openings in a single posting.
(e) CVs must contain accurate information on an individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf.
(g) We are under no obligation to monitor the documents posted on the site, but we may monitor documents at random. Documents found to be in violation of the above posting rules may be removed at our sole discretion.
h) Freecruiter endeavours to monitor its website content daily. The views and opinions expressed in the blog section are those of the authors and do not necessarily reflect the views or position of Freecruiter.
16.2 Conduct rules
(a) You may not provide a response to job postings by other users in any way or for any reason other than that which is expected (i.e., to apply for the job or to initiate further discussion with the candidate). Communications soliciting or advertising the employer's business are strictly prohibited.
(b) You may not send unsolicited commercial emails to users.
(c) You must protect your password. Your Freecruiter account and any related services accessed through it can only used by you. Upon successful registration for an account with Freecruiter, you will be provided with a unique password that permits you access to your account. You may not provide the password to your Freecruiter account to any third party. You are responsible for the confidentiality of your password. You agree to keep your password confidential, to change your password on a regular basis, and to maintain appropriate and regularly updated malware scanning and cleaning tools on your network and individual computer(s).You take responsibility for all uses of your account, whether or not they were authorised by you. If others use your password to post inappropriate material on the site, you are at risk of losing your access to the site. You agree to notify us immediately if there is any unauthorised use of your account or password.
(d) You agree to report inappropriate postings or conduct to our contact us section under the title “feedback”.
(e) You will not delete or make revisions to any material posted by any other person or entity.
(f) If at any time we understand that you have: (i) misled us regarding your business practices or services, or (ii) purchased services that do not represent your precise business, we reserve the right to terminate your agreement and your account.
17. Copyright complaints
We fully respect the intellectual property of others. Our policy is to respond to claims of copyright and other intellectual property infringement. We will investigate notices of alleged infringement and take appropriate action under the applicable intellectual property laws. We will terminate access for Users who are repeat infringers.
18. Refund policy
We are unable to refund any funds, service or product purchased on the system. Misspent funds within the system will also be non-refundable.
19. License to use by job seekers
We grant you limited, terminable, non-exclusive rights to access and use the site for your personal use in seeking employment opportunities only for yourself. This authorises you to view and download a single copy of the material on the site for your personal, non-commercial use.
You agree that you are solely responsible for the content of any document you post to the site and any consequences arising from a posting. Your use of the site is a privilege, and we reserve the right to suspend or terminate that privilege for any reason at any time, at our sole discretion.
All direct mails under the sections “Mass Mail Employers” will be reviewed by our internal administrative team. If persistent misuse of the site by way of commercial, explicit or generally inappropriate mails as assumed by Freecruiter is made, we reserve the right to terminate your account without notice.
20. License to use by employers
We grant you limited, terminable, non-exclusive rights to access and use the site for your internal business use, solely to seek candidates for employment. This authorises you to view and download a single copy of the material on the site for your personal use, directly related to searching for and recruiting job prospects. We also grant you a limited, terminable, non-exclusive licence to use our materials and services for your internal use only. You may not sell, transfer or assign any of the services or your rights to any of the services provided by us to any third party without the express written authorisation from Freecruiter. You agree that you are responsible for the content of any document you post to the site and any consequences arising from such posting. We reserve the right to suspend or terminate your access and use at any time, if we determine that you are in breach of these Terms and Conditions.
Although Freecruiter makes every effort to screen and select suitable candidates based on matching criteria within the “Freelance recruiter recommended CV” section, we accept no responsibility for the candidates within this section being interested in the position for which they have applied.
If a candidate via the freelance recruiter system is viewed on site by an employer and then hired outside of the system the employer is responsible to make the required payment needed unless they are able to show proof this candidate was previously in their personal talent database. This proof may be one of the following;
1. A copy of the date stamped email communication between said candidate and said employer
2. A clear unaltered photo of the ATS system with the required profile creation date visible.
Freecruiter reserves the rights to take necessary legal action if the above proof is not provided to retrieve said funds. Only companies who agree to and send a signed, dated and stamped copy of our terms of business contract will have their jobs visible to the community of freelance recruiters and industry professionals.
Freecruiter reserve the right to pursue legal action if there is any found breach of the terms of business. Payment terms to freecruiter for the service of candidates found by our community freelance recruiters and industry professionals will be defined in the terms of business.
21. Licence to use by Freelance Recruiters
Freecruiter grants you limited, terminable, non-exclusive rights to access and use the site only for your personal use in recommending/referring candidates to employers on this site, and to view job requisitions and recommended suitable candidates. Freelance recruiters are not required to know directly or indirectly the candidates they refer. Once you submit a candidate, the ownership of said candidate is passed to Freecruiter. You will have limited ownership on the system referred to as “exclusivity” to the specific employer you have submitted the aforementioned candidate for 90 days after the candidate is approved by freecruiter administration Any action within the first 90 days made from yourself or directly from the candidate in regards to applying for any position with the specific company you initially referred them to on freecruiter will be accredited to your profile. If the candidate applies to another company during or after this 90 day period he will not be accredited to your account. After the 90 day period you will lose exclusivity over the candidate and other freelance recruiters will be able to recommend them to this and other companies.
Although Freecruiter aims to pay all withdrawals within 3 working days, we make no guarantees for the time in which payment is processed with the bank or exchanging party.
Freecruiter is not responsible for bank charges or fees accrued by sending payment for withdrawn funds, these will be taken from the payment sent. All Freecruiter payments are made in US dollars. We do not take any responsibility for currency fluctuations. A Freelance recruiters recommendations will be tracked for authenticity, if a profile is fake or a bot then Freecruiter reserves the right to terminate immediately and remove funds from the balance of the freelance recruiters account. Freecruiter reserves the right to contact any candidate submitted by freelance recruiters in order to confirm their identity. This will be carried out ‘off system’. In the instance fake profiles are created, Freecruiter reserves the right to withhold all withdrawals - otherwise known as “Withdraw Funds”. Freecruiter is not responsible for the accuracy of bank details submitted by Freelance recruiters, and in turn is not responsible for delays in process time.
Freecruiter is not responsible if a candidate who is hired and quits within the first 30 days otherwise known as the employment guarantee period, and in the same context is not required to make payment for this placement.
If the job is posted as a % of the candidate salary Freecruiter is not responsible for fluctuations
between the estimated reward fee shown on the system during the time of job posting and the reward paid by the employer as this is dependent on the final salary offered to the candidate.
If a job is posted as a fixed fee and changed at a later date the fee will be frozen to its value at the time of recommendation.
We reserve the right to withhold funds if we are unable to verify the freelance recruiters identity due to incomplete/missing personal information including but not limited to; bank details, proof of residence and government issued identification. Freecruiter will hold funds during this process for a maximum of 90 days from the original request after this point a freelance recruiters profile will be considered as fake, underage, or as part of a money laundering operation and the funds will be removed. Underage is considered anyone who is younger than 18 years old on the date of recommendation of the candidate.
If a candidate is viewed on site by an employer and then hired outside of the system it is the freelance recruiters responsibility to highlight this to freecruiter via the contact us system. Freecruiter is then responsible to follow up with the employer directly or take the relevant actions required. We take no responsibility with regards to attaining the needed funds from said employers and have no responsibility to pay the freelance recruiter if the funds are not attained.
